General terms of use

PREAMBLE

These general terms and conditions of use of the website (the "GCU") are published by Mixity, a simplified joint stock company with variable capital of €25,000, registered under number 848 373 023 R.C.S. Nantes, with registered office at 6 rue Edouard Nignon, 44300 Nantes ("Mixity"). The purpose of these terms and conditions is to define the conditions of use of the Mixity website. www.mixity.co (le «Website »).


 


The GCU are addressed to any person browsing the Site (the "Visitor"), including for the purpose of consulting the "Diversity and Inclusion" footprints of the companies listed on the Site. 


 


By browsing the Site, the Visitor acknowledges having read and accepted, in their entirety and without reservation, these GCU, and undertakes to comply with them. If the Visitor has any reservations about all or part of the GCU, he/she must not continue to use the Site. Mixity reserves the right to modify these GTU at any time. Visitors are therefore advised to consult them regularly.


1. SITE ACCESS

Access to the Site is free of charge. It requires the Visitor to have a broadband Internet connection and equipment enabling him to access and browse the Site (computer, telephone, etc.). Internet connection and equipment, as well as any costs incurred by their use, are the sole responsibility of the Visitor.

The Site provides access to the Mixity platform via the "Connect" tab. The Visitor is hereby informed that access to the platform is reserved exclusively for Mixity customers and their users, as well as Mixity's solution partners.


2. TERMS AND CONDITIONS OF USE

The Visitor undertakes to use the Site in good faith and, in this respect, undertakes not to :

disrupt or interrupt access, the peaceful use by any other visitor or the proper functioning of the Site, including via the introduction of viruses, malicious code or any other technology harmful to the Site,
test the vulnerability of the Website, violate the Website's security, identification and authentication measures or, more generally, enter or attempt to enter the Website or the Mixity platform in an unauthorized manner,
use the Site for purposes other than those for which it was intended,
engage in any form of illicit extraction of data from the Site, in particular via web scraping,
use the Website in any way whatsoever for the purposes of designing, producing, distributing or marketing similar, equivalent or substitute products or services, or similar, equivalent or substitute documentation.


3. INTELLECTUAL PROPERTY

The Website and its content are protected by intellectual property rights, including copyrights and trademarks, which are the exclusive property of Mixity and/or its licensors. Any representation or reproduction, in whole or in part, of the Website, without the express authorization of Mixity, shall constitute an infringement within the meaning of articles L.335-2 of the French Intellectual Property Code. The same applies to the databases available on the Website, which are protected by the provisions of the French Intellectual Property Code.


These GCU must not be interpreted as transferring ownership of the Site to the Visitor.


4. RESPONSIBILITY

The Site is provided "as is", without warranty of any kind. Mixity does not warrant that the Site is free of errors or omissions or that the Site will always be available and accessible on an uninterrupted basis. Access to the Site is permitted on a temporary basis. Mixity reserves the right to suspend, withdraw, interrupt or modify all or part of the Site without notice.

Visitors acknowledge that they use the Site at their own risk. Visitors are expressly reminded that the Internet is not a secure network. Mixity cannot therefore be held responsible for contamination by viruses or intrusion by a third party into the Visitor's terminal system, and declines all responsibility for any consequences resulting from access to the Website that are not attributable to Mixity. In particular, Mixity may not be held liable for any damage caused to the Visitor's computer equipment and the data stored therein, or for any consequences arising from such damage to the Visitor's personal or professional activity. It is therefore the Visitor's responsibility to take all appropriate measures to protect his or her equipment and the data stored on it against any attack.

Mixity declines all responsibility in the event of malfunction of the Internet network, telephone lines or reception equipment preventing access to the Site.

The Website may contain links to third-party websites that Mixity does not control. Mixity is not responsible for the privacy practices or the content of such websites.


5. PERSONAL DATA PROTECTION

Mixity may collect personal data concerning the Visitor in its capacity as data controller. For further information on how personal data is processed, the Visitor is invited to consult Mixity's Privacy Policy.


6. APPLICABLE LAW - DISPUTES

These GCU are governed by French law.

In the event of a dispute, the Visitor is invited to contact Mixity first, using the form available online, in order to find an amicable solution. In the absence of an amicable solution, any dispute arising in connection with these GTUs shall be submitted to the competent French courts. The Visitor is however informed that he/she may have recourse to a conventional mediation procedure or any other alternative dispute resolution method, prior to any legal action.
